Summary
The Qatar Financial Centre Civil and Commercial Court, Appellate Division, refused Marilon QFZ LLC's application to appeal and stay the execution of a judgment ordering it to pay Dalba Engineering & Projects Co Limited USD 200,000 plus costs. Dalba, based in Brazil, had paid Marilon for bitumen that was never delivered. Marilon claimed improper service of the original claim and application, but the court found service was correctly made by recorded delivery. The application was also out of time, and Marilon failed to provide grounds for an extension. Consequently, Marilon must pay Dalba's costs for the appeal application.
