The Court issued three new Practice Directions in 2021.
PRACTICE DIRECTION 1 OF 2021
Practice Direction 1 of 2021 concerns permission to appeal applications and sets out who such applications are to be structured, making appropriate references to the trial bundles that were before the First Instance Circuit of the Court.
PRACTICE DIRECTION 2 OF 2021
Practice Direction 2 of 2021 addresses the electronic filing and service of documents before the Court. There is now a presumption in favour of electronic filing unless the Registrar or a Judge directs otherwise. Claim Forms will be issued electronically by the Registry. Electronic service of a Claim Form on a Defendant is only permissible where the Registrar or a Judge is satisfied that electronic service is likely to be received by the other party and is reasonable in all the circumstances.
PRACTICE DIRECTION 3 of 2021
Practice Direction 3 of 2021 deals with the award of post-judgment interest by the Court. In particular, it provides for an enhanced rate of post-judgment interest to be awarded in the event of non-compliance with an order of judgment of the Court. As a default position, it provides that a compensatory rate of interest of 5% will apply to all judgments from the time the Court found the sum due should have been paid and, if the judgment sum is not paid within 30 days, an enhanced interest at the rate of 7% from that date until payment.
