Summary
The court dismissed Devisers Advisory Services LLC's claims and upheld the counterclaim by Farwin Farook Muhammed. Devisers is ordered to pay QAR 32,500 plus 5% interest from March 11, 2023, and cover the defendant's reasonable costs. The dispute arose from a visa application contract. Despite the defendant's wife failing to obtain an IELTS certificate, the court found the retention of the full payment by Devisers unreasonable under Article 107 of the QFC Contract Regulations 2005. The court followed a precedent, reducing the amount retained by Devisers to QAR 5,000 for their services.
